Welcome to JM Brand Solutions. These Terms of Service ("Terms") govern your use of our digital marketing services. By working with us or accessing our website, you agree to these terms. If you do not agree, please do not use our services.

1. Services Offered

JM Brand Solutions provides digital marketing services, including but not limited to:

  • Social media content creation and management

  • Paid advertising strategy, setup, and management (Facebook, Instagram, Google, etc.)

  • Content planning and calendar development

  • Analytics tracking and performance reporting

In the future, we may offer access to additional digital tools, software platforms (SaaS), and downloadable resources. These services may be subject to separate terms.

2. Client Eligibility

We currently serve clients based in the United States. You must be 18 years or older and legally authorized to represent your business. We reserve the right to decline service to any individual or company at our discretion.

3. Packages, Pricing, and Payment

  • Services are provided based on predefined packages or custom proposals.

  • Full payment is due prior to the start of work, unless otherwise stated in writing.

  • Monthly retainers renew automatically unless canceled with proper notice.

  • We accept major credit cards and ACH transfers through secure payment platforms.

  • All payments are non-refundable once work has begun.

Additional services outside the agreed package may be subject to a separate fee. Clients will be notified and must approve any additional charges before work proceeds.

4. Client Responsibilities

To ensure timely and high-quality delivery, clients agree to:

  • Provide access to necessary platforms (e.g., Meta Business Suite, Google Ads, etc.)

  • Share brand assets (logos, colors, messaging) and relevant content

  • Respond to communications and approve materials in a timely manner

  • Follow all legal and advertising compliance guidelines applicable to their industry

Failure to do so may result in delays or paused service.

5. Termination & Cancellation

Either party may cancel services with 14 days’ written notice. In the event of cancellation, the client will be billed for any work completed up to the termination date.

JM Brand Solutions reserves the right to suspend or terminate services at any time due to:

  • Late or non-payment

  • Breach of agreement

  • Unprofessional or abusive conduct

  • Failure to provide access or requested materials

6. Intellectual Property

All final deliverables created by JM Brand Solutions (posts, graphics, ads, etc.) become the client’s property after full payment is received.

Internal tools, templates, strategies, and systems developed by JM Brand Solutions remain our proprietary intellectual property and may not be reused or resold without express written consent.

7. Confidentiality

We treat all client information with the utmost confidentiality. Any business plans, access credentials, content, or internal data shared with us will not be disclosed or used for any purpose outside the scope of the project.

8. Results Disclaimer

We aim to deliver high-quality marketing that helps our clients grow. However, marketing performance depends on many factors—including industry, audience, competition, and budget.

We do not guarantee specific results such as follower counts, revenue increases, or exact lead volumes.

9. Future Products & Software Access

If clients choose to subscribe to any software platforms, dashboards, or digital tools developed by JM Brand Solutions in the future, those products will be subject to additional licensing terms and/or subscription agreements.

10. Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Kentucky.

11. Changes to These Terms

We may update these Terms from time to time. The most current version will always be posted on our website with the updated effective date. Continued use of our services after changes means you agree to the revised terms.
